How to Reply to a GST Notice: Format, Timeline and Checklist
GST notices have become routine - automated mismatch detection means even fully compliant businesses receive them. What separates a two-week closure from a year-long dispute is usually the quality of the first reply. Here's the process practising professionals follow.
Step 1: Identify what you've actually received
- ASMT-10: scrutiny notice pointing out discrepancies in returns - reply in ASMT-11.
- DRC-01/01A: show-cause or intimation of tax demand - the serious one; timelines are strict.
- GSTR-3A: failure to file - the fix is filing, not arguing.
- Section 61/73/74 references tell you whether the department alleges genuine error or intent to evade - your reply's tone and evidence depend on it.
Step 2: Map every allegation to your filing data
Most notices are mismatch-driven: GSTR-1 vs GSTR-3B, GSTR-3B vs GSTR-2B (ITC), or e-way bill data vs declared turnover. Before drafting a word, build a reconciliation table for the exact period and heads the notice cites. The majority of demands shrink dramatically once timing differences and credit notes are mapped.
Step 3: Draft the reply - structure that works
- Reference block: notice number, date, section, period - exactly as issued.
- Facts: what the returns actually show, period-wise, without argument.
- Reconciliation: the table. This is the reply's spine - annex working sheets.
- Legal position: cite the section and applicable circulars/rulings only where they directly apply.
- Prayer: state precisely what you seek - dropping of proceedings, acceptance of reconciliation, time for payment where genuinely owed.
Step 4: File within time - or ask for time properly
Reply windows (often 15-30 days) are jurisdictional. If you genuinely need more time, file a written extension request before expiry - an unanswered notice converts to an ex-parte order at the department's figures.
The capacity problem
A well-built reply takes 3-5 professional hours. A firm with 80 GST clients during scrutiny season does not have those hours. Regno's GST Notice Assistant parses the notice, runs the reconciliation against the client's filing data, and produces the structured draft - your professional reviews and signs, instead of starting from a blank page.
